Section 19 (Education Act 1996) places a duty on the Local Authority to arrange suitable education for children of compulsory school age who are unable to attend school and would otherwise not receive a suitable education. Schools should consider a Section 19 referral only after appropriate support, reasonable adjustments and graduated responses have been implemented and it remains clear that the child cannot access education within their current school provision.
Referrals for medical, physical health or mental health needs will be considered through the Section 19 Medical Panel. Referrals for other circumstances (where, other than illness or exclusion, it is not reasonably possible for a child to access suitable education in their current setting) will be considered through the relevant locality decision-making process. Submission of a referral does not automatically result in Section 19 provision being agreed, and schools remain responsible for providing suitable education while a decision is being made.
