The use of images and data protection

1. Introduction

This survey is conducted on an anonymous basis, for the purpose of an article for a legal journal. Our goal is to ascertain if data protection is fit for the industry by looking at how the legislation is currently applied.

Useful terms for the purposes of completing the survey:

GDPR: The General Data Processing Regulations 2016

Personal data: information that relates to an identified or identifiable living individual

Special category personal data:
  • personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership
  • genetic data
  • biometric data where used for identification purposes
  • data concerning health, sex life or sexual orientation
Lawful bases for processing:
  • consent
  • contract with the individual
  • legal obligation towards the individual
  • protection of vital interests of the individual, or performance of public duty
  • legitimate interests of the data controller
Industry relevant exemptions:
  • journalism, academia, art and literature
  • research, statistics and archiving
